Terms of Service
The short version. Rentiqa is software that lets renters, tenants, hosts, landlords and contractors find each other and get things done — listings, applications, leases, bookings, rent, repairs and payouts — in one place. Rentiqa is not a landlord, a broker, a property manager, a lender or a party to any lease, booking or job. When money moves through Rentiqa, we hold it only long enough to pass it to the person it belongs to. These Terms are the agreement between you and Rentiqa LLC for using the Rentiqa website and app.
1. Who we are and what these Terms cover
The Rentiqa website (rentiqa.com) and the Rentiqa application (app.rentiqa.com, together the "Service") are operated by Rentiqa LLC ("Rentiqa", "we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. Payments, cancellations and refunds are described in our Refund Policy, and every time limit, window, validity period, deletion period, limit and fee referred to in these documents is set out in the Schedule of Terms (the "Schedule"). The Refund Policy and the Schedule form part of these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to enter a binding contract to use the Service. If you use the Service for a company, you confirm you are authorized to bind it.
2. Beta
Rentiqa is currently in beta. New accounts are reviewed and approved by hand, and we may decline an account without giving a reason. During the beta, all payment features run in test mode: no real card or bank account is charged, no real deposit is held and no real payout is made. We may change, reset or remove beta features and data, and we may end the beta or your access to it at any time, without liability. When real payments are switched on we will tell you in the app and update this section; the payment terms below describe how the Service works from that point.
3. Your account
- One account per person, in your own legal name. Keep your login private and tell us at once if you think someone else has used it. You are responsible for everything done under your account, whether or not you authorized it, until you tell us.
- The Service adapts to what you do: list a property and you see landlord or host tools; apply for a lease and you see tenant tools; onboard as a contractor and you see jobs. One account can hold several of these roles.
- We may suspend or close an account, with or without notice, that breaks these Terms, that we cannot verify, or that we reasonably believe is being used for fraud, harassment, evasion of these Terms or unlawful activity. Fees already paid for a breached account are not refunded. You can close your account from your settings; section 16 explains what happens to your data.
- You may not open a new account to get around a suspension, and you may not let someone who has been suspended use yours.
4. Rentiqa's role
Rentiqa provides the tools. The lease is between the tenant and the landlord. The booking is between the guest and the host. The job is between the contractor and the person who hired them. Rentiqa does not own, inspect, manage or guarantee any property; does not vet the truthfulness of listings; does not decide who gets a lease or a booking; does not check contractors' licenses, insurance or work; and does not employ anyone you meet on the Service. You deal with other users at your own judgment and are responsible for your own checks. Where the Service shows a verification badge, a screening summary, an income figure or a review, it reflects what a third party told us or what another user wrote — it is information, not a guarantee, not advice, and not something you may rely on in place of your own diligence. Rentiqa is not a party to anything you sign or agree on the Service and is not either side's archive: download and keep your own copies of your agreements, ledgers and receipts.
5. Listings and content
- If you publish a listing, you confirm you have the right to rent the property on the terms you post, that the listing is accurate, and that you will keep availability, pricing and house rules up to date. A listing that turns out to be fake, not yours, or materially misdescribed is a breach of these Terms, and any loss it causes another user is yours.
- You keep ownership of what you upload — photos, documents, messages, reviews. You give Rentiqa a worldwide, royalty-free license to store, display, adapt and transmit it as needed to run, promote and improve the Service, for as long as it is on the Service.
- Do not upload anything you do not have the right to share, anything unlawful, anything that discriminates on a basis protected by fair-housing law, or anything defamatory.
- Reviews must be about a stay or tenancy you actually had, must be honest, and may not be used to pressure another user. We may remove, edit for compliance, or decline to publish any content at our discretion, but we do not promise to monitor content and are not responsible for what users post.
6. Fair housing and the law where the property is
Landlords and hosts are responsible for complying with the laws that apply to their property and to renting it: fair-housing and anti-discrimination law, landlord–tenant law, security-deposit rules, short-term-rental registration and tax, licensing and safety codes. The Service lets you set screening criteria, late fees, deposit amounts and cancellation policies; choosing them lawfully is your responsibility. Rentiqa does not give legal, tax or financial advice, and nothing the Service shows you is such advice.
7. Applications, verification and screening
- Applications. A rental application you submit is shared with the landlord of that listing. Provide accurate information; a landlord may reject an application, or end a lease, over false statements, and a false statement to obtain housing may be a crime.
- Identity verification. Where a listing or feature requires it, you can verify your identity by submitting a government photo ID and a selfie to our identity-verification provider. The provider performs the check and holds the images. Rentiqa stores the outcome (verified or not, and when), and other users see only that outcome — never your documents. A verification is valid for the period in the Schedule, after which you may be asked to verify again. Submitting someone else's identity, or a forged document, ends your access permanently.
- Income verification. You may choose to connect a bank account through our financial-data provider so that income can be confirmed from your transactions. You can disconnect at any time from your settings.
- Screening reports. A renter may order a screening report about themselves. It belongs to the renter and is shared with a landlord only when the renter gives consent for that specific application. The report is prepared by consumer reporting agencies; a landlord sees a summary (for example a credit score band and major indicators), not the full file. Landlords who use a report to make a decision must follow the Fair Credit Reporting Act and any state equivalent, including giving an adverse-action notice where one is required, and may use the summary only for that application. Rentiqa is not a consumer reporting agency and is not responsible for the accuracy of what the agencies report.
- Fees for verification and screening, where charged, are shown before you order and are covered by the Refund Policy.
8. Electronic signatures
Leases and other agreements on Rentiqa are signed electronically. By signing you consent to conduct that transaction electronically and agree that your electronic signature has the same effect as a handwritten one, under the U.S. ESIGN Act and applicable state law. Before you sign, the full document is shown to you; the Service records a cryptographic hash of the document as sent, and rejects a signature if the document changed after it was sent. For each signature the Service records the signer's name, email, the time, IP address and browser, the consent given and the document hash, and gives each party a certificate of completion. Rentiqa provides the signing tool; it is not a party to the agreement, does not hold it on anyone's behalf, and is not responsible for its content, its enforceability, or whether the person who signed had authority to. You may withdraw your consent to sign electronically before signing by not signing; agreements already signed remain in effect between the parties. Download your signed documents and certificate from the app and keep your own copies — when an account is closed, its data is deleted as section 16 describes.
9. Rent and other payments between users
- Who pays whom. Rent, booking payments, deposits and job payments are payments from one user to another. Rentiqa collects them through its payment processor and passes them on as a limited payment agent of the person being paid: once a payer has paid Rentiqa, the payer has paid the recipient. Rentiqa is not a bank, does not lend, and does not pay interest on funds in transit.
- Payment methods. You can pay by card or by U.S. bank account (ACH debit). By adding a method you confirm it is yours to use and authorize Rentiqa and its payment processor to charge it for the payments you initiate or schedule, and for amounts you owe under section 15.
- Autopay. If you turn on rent autopay, you authorize recurring charges to your chosen method on the day of the month you pick, for the amount due under your lease (optionally capped at a limit you set), until you turn it off or the lease ends. You can turn autopay off in the app at any time before a scheduled charge.
- Late fees are set by the landlord under the lease, within the limits of local law, and posted to your ledger after any grace period the lease provides. They are a matter between tenant and landlord.
- Fees. Any platform or processing fee that applies to a payment is shown to you before you confirm it. There are no hidden fees.
- Failed payments and chargebacks. If a payment fails or is reversed by your bank, you still owe the underlying amount. Do not use a chargeback to dispute a payment you agreed to; contact us or the other party first. If a chargeback is raised and lost, the amount and the processor and administration charges it caused are recovered under section 15 from the person who received the funds or from the person who raised an unjustified chargeback, and an account that raises unjustified chargebacks may be closed.
10. Short-term bookings
- A booking request becomes a booking when the host confirms it. The host may decline.
- The booking total is charged when the host confirms. Rentiqa holds the funds and releases them to the host after the guest has checked out and the holding period in the Schedule has passed with no open claim, so that both sides are protected.
- A security deposit, where the listing requires one, is held rather than spent and is released after checkout unless the host makes a claim within the claim window in the Schedule. The guest may accept or dispute a claim within the response period in the Schedule. Rentiqa may review a disputed claim on the evidence the parties provide; it is not obliged to, is not an arbitrator, and may decline and leave the parties to resolve it. Where Rentiqa does decide, its decision on the deposit is final as between the parties on the platform, and either party may still pursue the other outside the platform. Filing a claim you know to be false, or disputing a claim in bad faith, is a breach of these Terms.
- Cancellations follow the cancellation policy shown on the listing when you booked, as set out in the Refund Policy.
- Guests must follow the house rules, occupy the property only with the people booked, and leave it as they found it, fair wear excepted. Hosts must provide the property as described. Each is responsible to the other for failing to.
11. Contractor jobs
- Landlords and hosts can post jobs; contractors can bid; the poster awards the job. Contractors are independent businesses, not Rentiqa's employees, agents or subcontractors, and are responsible for their own licenses, permits, insurance, taxes, safety and workmanship. Information a contractor gives about licenses and insurance is self-reported; verify it yourself before awarding a job.
- When the contractor marks the job done, the poster confirms it. Confirmation triggers payment, which Rentiqa collects from the poster and releases to the contractor's connected payout account. If a poster does not respond within the confirmation period in the Schedule, the work is treated as confirmed; if a confirmed job is not paid within the payment period in the Schedule, the contractor may charge the poster's default saved payment method, which the poster authorizes by awarding the job.
- Some jobs (for example moves ordered by a tenant) are paid in advance.
- Rentiqa does not guarantee any work, is not liable for injury or damage a contractor causes, and is not responsible for a contractor's failure to show up or finish.
12. Payouts
To receive money — as a landlord, host or contractor — you must set up a payout account with our payment processor, which will verify your identity and business details as the law requires. Payouts are sent to that account. Rentiqa may delay, hold, offset or reverse a payout to investigate suspected fraud or a breach of these Terms, to cover a chargeback, refund, approved claim or amount you owe, or where the law or our payment processor requires. You are responsible for taxes on money you receive and for giving the processor accurate tax information.
13. Smart locks and connected devices
Property owners may connect supported smart locks to the Service and issue door codes to tenants and guests for the period of their stay. The devices and their cloud services belong to their manufacturers, not to Rentiqa. Rentiqa is not responsible for a lock that is offline, out of battery, or that fails to open or to lock; does not guarantee that a code will work, or be revoked, at any exact time; and is not liable for a lock-out, an unauthorized entry, or anything that happens on the premises. Owners must keep a physical means of entry available and remain responsible for the security of their property and for meeting any duty they owe occupants. Codes are for the person they were issued to and may not be shared.
14. What you may not do
- Use the Service to break the law, including fair-housing, consumer-protection and privacy law.
- Post a property you do not control, or take a booking or lease you cannot honor.
- Move a transaction started on Rentiqa off the platform to avoid its fees or protections, or use another user's contact details for anything other than the transaction.
- Harass, threaten or defraud anyone; impersonate anyone; misrepresent your identity, income, licenses, insurance or history; collude with another user to obtain a refund, payout or claim you are not entitled to.
- Scrape, copy, probe, overload or interfere with the Service; use it to build a competing dataset; bypass its security, rate limits or verification challenges; or use automated tools to book, bid or message.
- Upload malware or content you have no right to share.
15. Protecting the platform: fraud, holds and money you owe
- Investigations. If we reasonably suspect fraud, a false claim, a fake listing, collusion, a breach of these Terms or a risk to another user, we may hold funds in transit, freeze payouts, pause bookings and jobs, restrict features or suspend the account while we investigate, for no longer than the investigation hold limit in the Schedule unless the law or our payment processor requires longer. We may ask you for documents and information and may decide on the information we have if you do not provide them.
- Amounts you owe. Money you owe Rentiqa or another user under these Terms — a lost chargeback and its charges, an approved claim, an unpaid job, a refund we issued on your behalf, a fee, or a loss caused by your breach — is shown in the app as a balance owed. You authorize us to collect it from any payment method or payout balance on your account, and to set it off against anything we owe you. If it stays unpaid, we may refer it to a collection agency, report it as the law allows, and recover our reasonable collection costs and legal fees.
- Reversal. Where a payment, payout, refund or credit was made by mistake or obtained through a breach of these Terms, we may reverse it.
- Reporting. We may report suspected fraud, threats or unlawful activity to law enforcement, our payment processor and the other users affected, and may share the information needed to do so.
- No waiver by tolerance. If we let a breach pass once, or delay acting on it, we have not given up the right to act on it or on any later breach.
16. Ending your account
You can close your account from your settings. Your data is deleted within the deletion period in the Schedule. Before you close it, download anything you want to keep — signed agreements, certificates, ledgers, receipts — because Rentiqa is not an archive for either side. A record that belongs equally to another user (a lease you both signed, a booking, a message thread) stays in that user's account, with your personal details removed where the law allows, until they delete theirs. Closing waits while your account has an active lease, a booking that has not finished, an open claim or dispute, or money still to be paid in or out — so that no one is left unpaid — and completes once they are settled. The Privacy Policy says exactly what is deleted. Sections that by their nature should survive (amounts owed, section 15, content licenses, disclaimers, liability, indemnity, release, governing law and general terms) continue after your account is closed, however it was closed.
17. Our service, changes and availability
We work to keep the Service available and accurate, but we do not promise it will be uninterrupted, secure or error-free, and we may change, suspend or withdraw features or the whole Service. We will give reasonable notice of changes that materially reduce what you can do, except where a change is needed for security or legal reasons. Software, design, text and trademarks of the Service belong to Rentiqa or its licensors; these Terms give you a personal, non-transferable, revocable license to use the Service for its intended purpose, not ownership of it.
18. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, Rentiqa disclaims all warranties, express or implied, including fitness for a particular purpose, non-infringement, and any warranty about the condition, safety or legality of any property; the identity, conduct, solvency, licensing or insurance of any user; the accuracy of any listing, verification, income figure, screening summary or review; the enforceability of any agreement signed on the Service; or the operation of any third-party device, network or service, including the payment processor and the banks and card networks it relies on. Nothing in these Terms limits rights that consumer law gives you and that cannot be waived.
19. Limitation of liability
To the fullest extent the law allows, Rentiqa and its members, officers, staff and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost rent, lost bookings, lost data, property damage, personal injury or the acts or omissions of any user or third party, arising from your use of the Service or your dealings with other users, however caused and even if we were told it was possible. Rentiqa's total liability to you for all claims arising from the Service in any twelve-month period is limited to the greater of the liability cap in the Schedule or the fees you paid Rentiqa in that period (payments passed through to other users are not fees paid to Rentiqa). Any claim against Rentiqa must be brought within the claims period in the Schedule after it arose, or it is waived.
20. Indemnity
You will defend, indemnify and hold harmless Rentiqa and its members, officers, staff and contractors against claims, losses, fines and reasonable legal costs arising from your listings or content, your breach of these Terms or the law, your dealings with other users, a property you list or occupy, work you perform or commission, or a chargeback, claim or dispute you raise in bad faith — except to the extent caused by Rentiqa's own breach or misconduct.
21. Disputes between users; release
Disputes between users — over a lease, a stay, a deposit, a job, a review, a message — are between those users. Rentiqa may provide tools or information to help, and may review a deposit claim as section 10 describes, but has no duty to mediate, decide or enforce anything between users, and doing so once does not create a duty to do so again. To the fullest extent the law allows, you release Rentiqa from claims, demands and damages of every kind, known or unknown, arising out of or connected with a dispute you have with another user or with a third-party provider.
22. Governing law and disputes with Rentiqa
These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-law rules. Any dispute between you and Rentiqa that cannot be resolved by talking to us first (write to [email protected]) will be brought in the state or federal courts located in Middlesex County, Massachusetts, and you consent to their jurisdiction and venue. Either party may bring a qualifying claim in small-claims court instead.
23. General
- Notices. We may give you notice by email to the address on your account or in the app, and it counts as received when sent. Notices to us go to [email protected]. A message sent through the Service to another user is not a legal notice under a lease or other agreement unless that agreement says so; Rentiqa is not anyone's agent for receiving notices.
- Assignment. You may not transfer your account or these Terms. We may assign them to a successor of the Service.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including outages at our payment processor, hosting provider, banks or card networks.
- Entire agreement; severability. These Terms, the Privacy Policy, the Refund Policy and the Schedule are the whole agreement between you and Rentiqa about the Service and replace anything said or written before. If a court finds a part unenforceable, the rest stands and the part is enforced to the extent allowed.
- No third-party beneficiaries. These Terms create rights only for you and Rentiqa.
- Interpretation. Headings and the short version are for convenience; the numbered sections govern. "Including" means "including without limitation".
24. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days' notice by email or in the app before they take effect, except where a change is needed for security or legal reasons, and your continued use after that date is acceptance. The current version is always at rentiqa.com/terms; the date at the top is the effective date.
